Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Creator Class (the “Service”), provided by Creator Class (“we”, “us”, “our”). By creating an account, signing in with Fanvue, or otherwise using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use Creator Class. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate and current.

2. Accounts & Access

Creator Class accounts are linked to your Fanvue account via OAuth. You are responsible for maintaining the security of your Fanvue credentials and for any activity that occurs under your account. You must notify us immediately of any unauthorised access.

We may suspend or terminate accounts that violate these Terms, that we reasonably believe are being used fraudulently, or where required by law.

3. Roles

• Creators — users who build and publish paid courses on Creator Class for their fans.
• Buyers — users who purchase access to a creator’s course through Fanvue and are granted access to that course on Creator Class.

4. Fees, Purchases & Refunds

Course purchases are processed by Fanvue, not Creator Class. Pricing, taxes, billing, and refund eligibility are governed by Fanvue’s terms and policies. Where Fanvue revokes a buyer’s purchase access (for example, due to a refund or chargeback), the buyer’s access to the corresponding course on Creator Class will also be revoked.

Creator Class Premium is billed through the Fanvue App Store. We do not direct creators to off-platform payment flows for paid Creator Class functionality.

5. Acceptable Use

You agree not to:

• Use the Service to upload or distribute content that is unlawful, harmful, infringing, or violates third-party rights.
• Attempt to gain unauthorised access to any part of the Service, other accounts, or related systems.
• Interfere with or disrupt the Service or its underlying infrastructure.
• Use the Service to send spam, scrape data, or impersonate others.
• Resell, sublicense, or redistribute Creator Class itself (you may, of course, sell access to your courses through it).

6. Your Content

You retain all rights to the content you upload to Creator Class (lessons, files, course copy, and any other materials — “Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, and display Your Content solely as needed to operate and provide the Service to you and your buyers.

You are solely responsible for Your Content, including ensuring you have the rights to upload it and that it complies with applicable laws and these Terms.

7. Our Intellectual Property

The Service itself — including its software, design, branding, and trademarks — is owned by Creator Class and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except as strictly necessary to use the Service.

8. Third-Party Services

The Service integrates with third-party platforms, including Fanvue (sales and identity), Resend (email), Vercel (hosting), and Neon (database). Your use of those platforms is governed by their own terms. We are not responsible for the availability or actions of third-party services.

9. Termination

You may stop using the Service at any time and request deletion of your account by contacting us. We may suspend or terminate your access if you breach these Terms, if your Fanvue account is terminated, or where required by law. On termination, your right to use the Service ends immediately. Some provisions of these Terms (including IP, disclaimers, and limitation of liability) survive termination.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any information obtained through the Service will meet your expectations.

11. Limitation of Liability

To the maximum extent permitted by law, Creator Class will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the fees you paid us in the twelve months preceding the claim, or (b) GBP 100.

Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to indemnify and hold Creator Class harmless from any claims, losses, or damages (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or Your Content.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms on this page with a new “Last updated” date and, where appropriate, by other means. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
